Sales Agreement

This Distance Sales Agreement (“Agreement”) is entered into between:

and the individual or legal entity (“Customer”) who places an order through www.wearsamoda.com (“Website”).

This Agreement is prepared in accordance with Turkish Consumer Protection Law No. 6502 and related legislation.


1. Subject of the Agreement

This Agreement sets out the rights and obligations of the parties concerning the sale and delivery of products ordered electronically via the Website.


2. Product Information

All products listed and sold on www.wearsamoda.com are subject to this Agreement. The products offered in our online store include a photograph and the basic characteristics of the same, which are the information provided by the manufacturer.

The product’s colour, as shown in the photograph, is not binding. The product’s colour is identified in its characteristics


3. Pricing and Payment

All prices on the Website include VAT. Payment is made at the time of order via the offered secure payment systems. The Seller reserves the right to change product prices and campaigns without prior notice.


4. Order Confirmation and Delivery

Orders become valid upon confirmation and receipt of payment. Once confirmed, orders are processed and shipped within 2-5 business days, unless otherwise specified. Delivery times may vary depending on the shipping location and the logistics company used. USS MEDYA TICARET (SAMODA) is not responsible for delays caused by the logistics companies responsible for product shipment.

Shipping costs, if applicable, are clearly shown before the order is completed. No additional fees will be charged post-payment.


5. Return and Refund Policy

Returns:

SAMODA accepts returns of ready-made (non-custom) orders within 3 days of delivery in Turkiye and 7 days outside Turkiye, provided that the merchandise is new, unworn, unwashed, unaltered, and includes all original internal garment tags.

Exchanges:

If there is no quality or sizing issue, an exchange service is offered once for non-custom-made orders. Custom-made items without defects are not eligible for return or exchange.

To initiate a return or exchange, contact us at hello@wearsamoda.com or via WhatsApp at +90 501 062 04 92. Do not return the item to the address on the shipment label. Returns sent to the incorrect address will not be refunded.

If the return is due to customer preference (not a quality issue), the return shipping fee is the customer’s responsibility.
If the product is defective or incorrect due to our error, SAMODA will cover the return shipping cost.

Refunds:

Refunds will be issued via the original payment method within 7 business days after the returned item is received and confirmed to be in returnable condition. Refunds to alternate cards/accounts are not supported.

Partial Refunds or Price Differences:

If you exchange a product for a lower-priced item due to a product issue, the difference will be refunded. For a higher-priced replacement, the customer is responsible for the difference in cost.


6. Right of Withdrawal

In accordance with applicable consumer protection laws, the Customer has the right to withdraw from the purchase of any non-custom-made products without justification within 3 days of receiving the product within Turkiye, and 7 days outside Turkiye. The product must be unused and returned in its original condition. The return process must be initiated through the specified communication channels. Note that the right of withdrawal due to customer personal preferences or a change of mind can be exercised only once by the same customer.


7. Force Majeure

Events such as natural disasters, war, terrorism, or other unforeseeable circumstances that prevent either party from fulfilling contractual obligations are considered force majeure. In such cases, obligations are suspended until the effects of the force majeure cease. If such a condition persists for more than 10 days, either party may terminate the contract.


8. Dispute Resolution

In the event of a dispute, the Customer may apply to the Consumer Arbitration Committees or Consumer Courts located in their place of residence or where the transaction occurred, within the limits set by the Ministry of Commerce.


9. Acceptance

The Customer acknowledges that they have read and agreed to this Distance Sales Agreement upon completing a purchase through the Website.
